Califone reserves the right make partial shipments of products at any time prior to the guaranteed shipment date. Orders shall be deemed to have shipped when made available to the designated commercial carrier at the Califone warehouse facility (San Fernando, CA).

Buyer will be eligible for a refund or credit for those products ordered under this promotion which are not shipped by the guaranteed shipment date (between March 3 and June 26, 2015) set forth in an accepted purchase order. All requests for refunds or credit must be submitted to your authorized Califone dealer within 30 calendar days from the product ship date. Califone will not process any refund or credit requests received directly from the end purchaser.

Refund or credit is limited to product purchase price and excludes all taxes, shipping costs and any incidental, indirect or consequential damages, breach of contract, negligence, strict liability or other legal theory. This refund is buyer’s exclusive remedy for delayed shipment of product.

Promotion is not applicable to orders in which buyer has requested, or otherwise agreed to, a shipment date later than June 26, 2015.

Califone will not be liable for, nor will any refund or credit be given as a result of, late shipment of any orders caused by or resulting from circumstances beyond the control of Califone, including, without limitation, criminal acts of any person(s) or entities (including, but not limited to, acts of terrorism or public enemies), governmental act, law or regulation, local disputes, riots or civil commotion, hazards incident to a state of war, invasion or hostilities, strikes or anticipated strikes, labor disruptions or shortages caused by pandemic conditions or other public health event or circumstances, accidents, fires, explosions, local or national weather conditions or natural disasters (including earthquakes, cyclones, storms, floods and hurricanes) and other “acts of God.”
